Where do I stand on grandparent visitation rights?

[caption id="attachment_175" align="alignright" width="142" caption="THIS IS WONDERFUL"][/caption]

This can be a confusing question to answer. As far as state laws go, many states still allow for grandparents visitation. The problem with this is that there are only certain circumstances and situations in which a grandparent can file for visitation rights. Since the Supreme Court ruled in 2000 that parents that are, and this is important, “deemed fit” have the controlling rights over their children and rightfully so. Ma Read More

Baby-Boomers are now Grand-Boomers

It is official, the baby-boomer generation has entered into the grandparents right of passage. Since the definition of a baby boomer is anyone born between 1946 and 1964 and the average age for a new grandparent is 48 that places a lot of those folks into what is being called the Grand-Boomers. I kind of like that term even though I am too old to qualify.

This classification was significant enough that AARP did a breakout study of this age group in it’s 2002 “Grandparent Study Report”. What they found is that the Grand-Boomers are a little bit different than previous generations of grandparents. As a group they are more physically active with their grandchildren which may be a function of the age of the new grandparents coming down over the pas Read More

Information on grandparents visitation rights

Over the last several years there has been a law created to give grandparents visitation rights. There are laws like this now in every state. Before then there was no such law and grandparents had no legal rights to even attempt to have visitation. If a parent did not want a grandparent to see their grandchildren and tried to stop, any type of visitation there was no law that gave the grandparents any options to go back on. Grandparent’s rights may be different in each state. Some states may allow the grandparents to go to court to seek visitation although there is no certain guarantee that it will happen. Other states may have set laws that let grandparents have some form of visitation with needing to be a part of their grandchild’s life.

Influencing grandparents rights

There exists a debate in the country as to whether grandparents have the right to visit their grandchildren or not.

Many people believe that a child must have contact with their grandparents in order to learn the family history and to grow into a good person.  Others say a child can be raised with or without the input of grandparents and no harm is done.

Unfortunately, the constitution of the United Read More

GRANDKIDS RIGHTS AS WELL AS GRANDPARENTS RIGHTS

There are many stories of grandparents being denied visitation with their grandchildren.  The brutal facts are that constitutionally the grandparents do not have any rights when it comes to visitation with grandchildren.  Then you have the fact that laws on grandparents rights vary from one state to another and the situation can get very confusing.  Most people will agree that the relationship between grandparents and grandchildren is very important to both parties.  The problem is that the law does not see things in the same light.  If a parent wants to deny visitation to a grandparent the grandparent can file for visitation rights but the chance of winning is slim unless there are extenuating circumstances.

So many different situations can arise where a grand Read More

GRANDPARENTS RIGHTS FOR CUSTODY AND VISITATION

If you are a grandparent seeking to find out what your rights are concerning your grandchildren when you start asking questions you may find that most people do not think that a grandparent has any rights if the parents object to visitation.  The sad thing is that these people are correct for the most part.  At this time there is no constitutional law in the United States that gives grandparents visitation rights.  Fortunately, in some states and in some si Read More

Grandparents visitation is not always guarenteed

Here we are just merrily skipping down the wonderful path of grandparenthood. Ain’ t life wonderful? We see and/or talk with our grandkids on an average of every 2 weeks according to AARP’s 2000 study on grandparents. We throw in a sleepover now and then, maybe a few days spent together while they are on summer vacation. I like to think of this as “Eating the icing on the cake of life as it should be”. These grandangels bring and leave behind heaping portions of Read More

TIPS ON MAINTAINING YOUR GRANDPARENTS RIGHTS

Here is an opportunity to prove two true but cliché statements.  One is “An ounce of prevention yields a pound of results” and “Luck is where preparedness meets opportunity”.

When it comes to your grandchildren or someone close to you with grandchildren there are a couple of things you can and should do to be ready in case life happens in a way that you least expect.  With the divorce rate approaching 50% the odds are that you or someone close to you will need to avail themselves of their Grandparents rights when it comes to visitation and/or custody of one or more grandchildren.  I realize this is a little like planning for your funeral,  it is Read More
